“While Uberspace didn’t host the open source software, it was held responsible for the website linking to the software hosted on developer platform GitHub.”

Sony, Warner and Universal lost the GitHub fight in 2020, so they sued the German company hosting youtube-dl’s website instead. The Hamburg court admitted YouTube’s rolling cipher is far from perfect and ruled that the average user acts in bad faith anyway. The labels posted a €20,000 bond, and the owner faced a €250,000 fine or jail if he kept the site up. The software is still on GitHub. Only the small host that linked to it got punished.
