Nintendo hit 8,535 GitHub repositories carrying Yuzu code, two months after Yuzu’s developers settled for $2.4 million rather than fight. Nobody tested the legal theory in court. The settlement became the precedent and the DMCA notice did the rest. Nintendo didn’t even sign its own name to the takedown.
