“Covered individuals would have a private cause of action against employers that violate the law and, if found liable, employers would be subject to up to $10,000 in liquidated damages for each violation, as well as payment for lost compensation, damages, and attorneys’ fees and costs.”
New York’s Senate passed S3100A, a flat ban on non-competes for employees and contractors, with $10,000 per violation and a private right to sue. The companion bill S6748 also counts overbroad NDAs and training-repayment clauses as de facto non-competes. That closes the loophole employers would reach for next. Both bills still need the Assembly and Kathy Hochul. When employer lawyers call a change monumental, workers are winning something.
