Section 702 exists to spy on foreigners. The FBI used it to run warrantless queries on 133 people arrested at George Floyd protests and more than 19,000 donors to a congressional campaign. Justice found only eight of those donor identifiers had any real foreign link. The secret court called the abuse “persistent and widespread” in April 2022, and the public saw it a year later, months before Congress votes on renewal.
